AN ACT
Concerning the circumstances under which a person is required to register as a sex offender based upon a conviction in a jurisdiction other than Colorado.
Be it enacted by the General Assembly of the State of Colorado:
SECTION 1. 16-22-103 (3), Colorado Revised Statutes, is amended to read:
16-22-103. Sex offender registration - required - applicability - exception. (3) In addition to the persons specified in subsections (1) and (2) of this section, any person convicted of an offense in any other state or jurisdiction, including but not limited to a military or federal jurisdiction, for which the person, as a result of the conviction, is, was, has been, or would be required to register if he or she resided in the state or jurisdiction of conviction, or for which such person would be required to register if convicted in Colorado, shall be required to register in the manner specified in section 16-22-108, so long as such person is a temporary or permanent resident of Colorado. Such person may petition the court for an order that discontinues the requirement for registration in this state at the times specified in section 16-22-113 for offense classifications that are comparable to the classification of the offense for which the person was convicted in the other state or jurisdiction.
SECTION 2. Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
