AN ACT


Concerning bail for persons charged with driving under the influence and felony vehicular eluding arising out of the same occurrence.

 


Be it enacted by the General Assembly of the State of Colorado:

 

  SECTION 1.  16-4-103 (1), Colorado Revised Statutes, is amended BY THE ADDITION OF A NEW PARAGRAPH to read:

 

  16-4-103.  Fixing of bail and conditions of bail bond. (1) (b.5)  If a person is arrested for vehicular eluding under section 18-9-116.5, C.R.S., and driving under the influence under section 42-4-1301, C.R.S., arising out of the same incident, the bail for such person shall be fifty thousand dollars, or such amount as is set by the court after consideration of all relevant factors.

 

  SECTION 2.  Safety clause. The general assembly hereby finds, determines, and declares that this act is necessary for the immediate preservation of the public peace, health, and safety.
