2. This act was passed without a safety clause. It shall take effect at 12:01 a.m. on the day following the expiration of the ninety-day period after final adjournment of the general assembly that is allowed for submitting a referendum petition pursuant to article V, section 1 (3) of the state constitution; except that, if a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, if approved by the people, shall take effect on the date of the official declaration of the vote thereon by proclamation of the governor.

If such a referendum petition is filed against this act or an item, section, or part of this act within such period, then the act, item, section, or part, shall take effect only if approved by the people and will be effective on the specified date or on the date of the Governor's proclamation, whichever occurs later.
13. Senate Bill 00-144 superseded by House Bill 00-1185. The amendments to this provision as contained in Senate Bill 00-144 are duplicated in section 5-1-301 (45) (a) as contained in the repealed and reenactment of article 1 of title 5 by House Bill 00-1185.
14. This provision will be renumbered as (1)(i) and harmonized with 5-6-104 (1) as repealed and reenacted by House Bill 00-1185.
