STATE PUBLIC DEFENDER
H.B. 00-1174 Alternate defense counsel - eliminate representation for partially indigent offenders - appropriation.
Repeals provisions that require alternate defense counsel to represent a partially indigent defendant. Repeals the
authority of the court, on its own motion or on the application of a partially indigent defendant, to appoint the
office of alternate defense counsel to provide representation for a partially indigent defendant. Repeals the
requirement that the office of alternate defense counsel provide legal representation to partially indigent persons
by contracting with licensed attorneys and investigators. Repeals the duties of the office of alternate defense
counsel to counsel and defend a partially indigent defendant and to prosecute any appeals or other remedies for a
partially indigent defendant.
Appropriates
$171,996 and 3.7 FTE to the judicial department for allocation to the
public defender for the
implementation of the act. Decreases by $174,794 the appropriation in
the general appropriations bill to the
judicial department for allocation to the alternate defense counsel.
