Joint Rule 22 - Strike Everything Below the Enacting Clause Amendments |

Under Joint Rule 22, a bill's prime sponsor may request that Legislative Council Staff prepare a fiscal note or a statement of no fiscal impact on a proposed amendment that strikes everything below the enacting clause of an introduced bill that has not been heard by the first committee of reference. An amendment that strikes everything below the enacting clause of a bill (commonly referred to as a "SEBEC" or a "Strike Below") proposes to substitute a new bill for the introduced bill under the same title. The fiscal note or statement of no fiscal impact will be in lieu of the fiscal note on the introduced bill that is otherwise required. To request a fiscal note on the amendment the prime sponsor must provide the Legislative Council Staff with a copy of the proposed amendment that strikes everything below the enacting clause and written permission granted by two members of leadership in the chamber where the bill was introduced. The prime sponsor must also authorize the immediate public release of the proposed amendment to the introduced bill that strikes everything below the enacting clause.
